SUMMARY OF THE ARGUMENT
Carl ConvictÕs rights to religious freedom as guaranteed under the
Establishment Clause of the first amendment were violated by special conditions
which were placed upon his probation which require Mr. Convict to participate
in acts which are in direct opposition to his religious beliefs and practices.
Furthermore, Mr. ConvictÕs rights to Free Exercise of his religious
beliefs as guaranteed under the so named clause of the first amendment
were violated by special conditions placed upon his probation which demand
that Mr. Convict abstain from acts required by his religious tenets.
Finally, an error was made in placing special conditions upon Mr. ConvictÕs
probation wherein such conditions are in no way related to the offense
of which Mr. Convict was convicted, the circumstances of said offense,
or the history of Mr. Convict.
